April lalu Dewan Perwakilan Rakyat (DPR) mengesahkan Undang-undang Informasi dan Transaksi Elektronik (ITE). Selain mengatur masalah transaksi elektronik, UU No 11 tahun 2008 ini juga mengatur ketentuan tentang informasi di dunia maya. Aturan-aturan itu rentan mengancam kebebasan berekspresi terutama pada Pasal 27 ayat (1), Pasal 27 ayat (3), Pasal 28 ayat (2), dan Pasal 31 ayat (3).
Pasal-pasal tersebut pada umumnya memuat aturan-aturan warisan pasal karet (haatzai artikelen), karena bersifat lentur, subjektif, dan sangat tergantung interpretasi pengguna UU ITE ini. Selain itu, materi pada pasal-pasal tersebut juga bertentangan dengan hak asasi manusia (HAM) terutama tentang kebebasan informasi dan kebebasan berekspresi maupun UUD 1945 tentang kebebasan berpendapat. Sebab setiap pengguna informasi, termasuk blogger di dalamnya, bisa diancam hukuman penjara kapan saja.
Melalui diskusi terbatas pada Minggu (11/05), maka kami pengguna informasi di dunia maya yang tergabung dalam Bali Blogger Community (BBC), menyatakan sikap sebagai berikut:
1. Menolak semua pasal-pasal dalam UU ITE yang bertentangan dengan HAM serta mengekang kebebasan informasi dan berekspresi.
2. Mendesak pemerintah agar segera menghapus pasal-pasal dalam UU ITE yang tidak sesuai dengan semangat kebebasan informasi dan berekspresi.
3. Mengajak semua anggota masyarakat untuk turut serta mendukung aksi-aksi menolak UU ITE dan peraturan lain yang mengekang kebebasan informasi dan berekspresi.
